The judge in the case stated that too much information was taken directly from the Harry Potter books for Vander Ark's planned book, the Harry Potter Lexicon, especially from the two Comic-Relief books, Fantastic Beasts and Where to Find Them and Quidditch Through the Ages.

Now it appears that Vander Ark and RDR Books are not giving up and are planning an appeal on the judge's decision some time this week. They are hoping that if they edit the book that the decision will come out differently. Vander Ark stated, "I've always been very much willing to work with[Rowling and Warner Bros.] and try to see what can be done."
